You may be owed money for unpaid overtime if you work more than forty (40) hours per week, and are not paid one and a half (1.5) times your regular rate of pay for each hour over forty (40), even if you are salaried. Under both federal and state law, the Fair Labor Standards Act and the New York Labor Law, respectively, employers must generally pay hourly employees and certain salaried employees an overtime rate of one and a half (1.5) times the regular rate for each hour worked over forty (40) per week.
